กรุณาอ่านข้อกำหนดและเงื่อนไขฉบับนี้อย่างละเอียดก่อนใช้บริการเว็บไซต์ของบริษัท การเข้าใช้งานเว็บไซต์ของท่านถือว่าเป็นการยอมรับข้อกำหนดและเงื่อนไขทั้งหมดที่ระบุไว้ในที่นี้ หากท่านไม่เห็นด้วยกับข้อใดข้อหนึ่ง โปรดงดเว้นการใช้งานเว็บไซต์
1. ข้อมูลทั่วไป
เว็บไซต์นี้จัดทำขึ้นและบริหารโดย บริษัท เฮเฟเล่ (ประเทศไทย) จำกัด (“บริษัท”) เพื่อให้ข้อมูลเกี่ยวกับสินค้าและบริการ รวมถึงให้บริการสั่งซื้อสินค้าทางออนไลน์แก่ลูกค้า โดยการเข้าชมเว็บไซต์นี้ ผู้ใช้งานตกลงว่าจะปฏิบัติตามข้อกำหนดและเงื่อนไขการใช้งานฉบับนี้ทุกประการ
บริษัทขอสงวนสิทธิ์ในการเปลี่ยนแปลง แก้ไข หรือยกเลิกเนื้อหาใดๆ บนเว็บไซต์ รวมถึงราคาสินค้า ราคาโปรโมชั่น และบริการ โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า ทั้งนี้ บริษัท จะไม่รับผิดชอบต่อความเสียหายใดๆ ที่อาจเกิดขึ้นจากการเปลี่ยนแปลงดังกล่าว
2. การใช้งานเว็บไซต์
a. ผู้ใช้งานตกลงจะใช้งานเว็บไซต์นี้เพื่อวัตถุประสงค์ที่ชอบด้วยกฎหมาย และไม่กระทำการใดๆ ที่อาจก่อให้เกิดความเสียหายต่อเว็บไซต์บริษัท หรือบุคคลอื่น ไม่ว่าทางตรงหรือทางอ้อม
b. ห้ามมิให้ผู้ใช้งานกระทำการใดๆ ดังต่อไปนี้:
i. ละเมิดสิทธิของผู้อื่นหรือบุคคลที่สาม
ii. ใช้เว็บไซต์ในลักษณะที่เป็นการหลอกลวง สร้างความรำคาญ หรือผิดกฎหมาย
iii. เข้าถึงระบบหรือข้อมูลของบริษัทโดยไม่ได้รับอนุญาต
iv. ทำการคัดลอก แก้ไข เผยแพร่ หรือแจกจ่ายเนื้อหาบนเว็ไซต์โดยไม่ได้รับอนุญาตจากบริษัท
c. บริษัทขอสงวนสิทธิในการระงับหรือยกเลิกการใช้งานเว็บไซต์ของผู้ใช้รายใดรายหนึ่งได้ทันที โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า หากพบว่าผู้ใช้งานฝ่าฝืนข้อกำหนดใดๆ หรือมีพฤติกรรมที่ไม่เหมาะสม
3. การสมัครสมาชิกและบัญชีผู้ใช้งาน
a. ผู้ใช้งานต้องสมัครสมาชิกและสร้างบัญชีผู้ใช้งานก่อนจึงจะสามารถสั่งซื้อสินค้าได้ โดยต้องระบุข้อมูลที่ถูกต้อง ครบถ้วน และเป็นปัจจุบัน เช่น ชื่อนามสกุล ที่อยู่ อีเมล และหมายเลขโทรศัพท์
b. ผู้ใช้งานมีหน้าที่เก็บรักษาชื่อบัญชีและรหัสผ่านไว้เป็นความลับ และต้องไม่เปิดเผยให้บุคคลอื่นทราบ หากพบการใช้งานบัญชีโดยไม่ได้รับอนุญาต ผู้ใช้งานต้องแจ้งให้บริษัททราบโดยทันที
c. ผู้ใช้งานต้องรับผิดชอบต่อการกระทำใดๆที่เกิดขึ้นภายใต้บัญชีของตนเอง รวมถึงความเสียหายที่อาจเกิดขึ้นจากการใช้งานโดยบุคคลอื่น
d. บริษัทขอสงวนสิทธิ์ในการระงับหรือยกเลิกบัญชีผู้ใช้งานที่ให้ข้อมูลเท็จ ไม่ครบถ้วน หรือมีพฤติกรรมที่ขัดต่อข้อกำหนดของเว็บไซต์
e. ผู้ใช้งานสามารถร้องขอลบบัญชีของตนได้ตลอดเวลาโดยติดต่อผ่านช่องทางที่บริษัทกำหนด ทั้งนี้ การลบบัญชีอาจมีผลต่อคำสั่งซื้อหรือบริการที่อยู่ระหว่างการดำเนินการ
f. ผู้ใช้งานตกลงยินยอมให้บริษัทเก็บรวบรวม ใช้ และประมวลผลข้อมูลส่วนบุคคลที่ให้ไว้ เพื่อวัตถุประสงค์ในการให้บริการ การจัดส่งสินค้า การติดต่อสื่อสาร และกิจกรรมทางการตลาด โดยเป็นไปตามนโยบายความเป็นส่วนตัวของบริษัท
4. การสั่งซื้อสินค้า
a. การสั่งซื้อสินค้าผ่านเว็บไซต์ถือเป็นข้อเสนอของผู้ใช้งานในการทำสัญญาซื้อขายกับบริษัท และจะสมบูรณ์เมื่อบริษัทได้ตรวจสอบและยืนยันคำสั่งซื้อดังกล่าว
b. การยืนยันคำสั่งซื้อจะมีผลเมื่อผู้ใช้งานได้รับอีเมลหรือข้อความยืนยันจากบริษัท โดยคำสั่งซื้อจะถือว่าอยู่ระหว่างการดำเนินการและไม่สามารถแก้ไขหรือยกเลิกได้ เว้นแต่เป็นไปตามเงื่อนไขการยกเลิกที่ระบุไว้
c. ผู้ใช้งานต้องตรวจสอบรายละเอียดสินค้า จำนวน ราคา และที่อยู่จัดส่งให้ถูกต้องก่อนยืนยันคำสั่งซื้อ บริษัทจะไม่รับผิดชอบต่อความผิดพลาดที่เกิดจากข้อมูลที่ผู้ใช้งานกรอกผิด
d. บริษัทขอสงวนสิทธิ์ในการปฏิเสธหรือยกเลิกคำสั่งซื้อไม่ว่าทั้งหมดหรือบางส่วน หากเกิดกรณีใดกรณีหนึ่งต่อไปนี้
i. สินค้าไม่มีสต๊อกหรือเลิกจำหน่าย
ii. ข้อมูลสินค้า เช่น ราคา หรือรายละเอียด มีข้อผิดพลาด
iii. ระบบการชำระเงินล้มเหลว หรือไม่ได้รับการยืนยันการชำระเงิน
iv. มีข้อสงสัยเกี่ยวกับการฉ้อโกงหรือการกระทำผิดกฎหมาย
e. ราคาสินค้าที่แสดงบนเว็บไซต์เป็นราคารวมภาษีมูลค่าเพิ่ม (VAT) และแสดงเป็นสกุลเงินบาท หากมีค่าขส่งเพิ่มเติม ระบบจะแสดงให้ผู้ใช้งานทราบก่อนดำเนินการชำระเงิน
5. การชำระเงิน
a. ผู้ใช้งานสามารถเลือกชำระค่าสินค้าผ่านช่องทางที่บริษัทกำหนด ซึ่งอาจรวมถึง
i. บัตรเครดิตหรือบัตรเดบิต
ii. การโอนเงินผ่านบัญชีธนาคาร
iii. ช่องทางการชำระเงินผ่านระบบออนไลน์อื่นๆ ที่บริษัทรองรับ
b. การชำระเงินจะถือว่าเสร็จสมบูรณ์เมื่อบริษัทได้รับการยืนยันจากระบบหรือหน่วยงานที่เกี่ยวข้องหากการชำระเงินไม่สำเร็จ บริษัทมีสิทธิระงับคำสั่งซื้อโดยไม่ต้องแจ้งให้ทราบล่วงหน้า
c. ผู้ใช้งานต้องรับผิดชอบต่อค่าธรรมเนียมจากการทำธุรกรรมใดๆที่อาจเกิดขึ้นจากการชำระเงิน รวมถึงความถูกต้องของข้อมูลกาชำระเงินที่ให้ไว้
d. บริษัทใช้ระบบที่มีมาตรฐานความปลอดภัยในการรับชำระเงิน และจะไม่จัดเก็บข้อมูลบัตรเครดิตหรือข้อมูลทางการเงินของผู้ใช้งานโดยตรง เว้นแต่ได้รับความยินยอมโดยชัดแจ้งตามนโยบายความเป็นส่วนตัว
6. การจัดส่งสินค้า
a. บริษัทจะดำเนินการจัดส่งสินค้าภายใน 10 วันทำการ นับจากวันที่ได้รับการยืนยันการชำระเงิน เว้นแต่จะมีการแจ้งกำหนดเวลาจัดส่งอื่นไว้โดยเฉพาะ
b. การจัดส่งจะดำเนินการผ่านผู้ให้บริการขนส่งที่บริษัทกำหนด โดยจัดส่งตามที่อยู่ที่ผู้ใช้งานระบุไว้ในขั้นตอนการสั่งซื้อ หากที่อยู่ไม่ถูกต้องหรือไม่สามารถจัดส่งได้ บริษัทขอสงวนสิทธิ์ในการปฏิเสธความรับผิดชอบต่อความล่าช้า หรือความเสียหายที่เกิดขึ้น
c. ค่าจัดส่งสินค้า (ถ้ามี) จะแสดงให้ผู้ใช้งานทราบก่อนดำเนินการชำระเงิน และรวมอยู่ในยอดรวมของคำสั่งซื้อ
d. ความเสี่ยงของความเสียหายหรือการสูญหายของสินค้า จะตกเป็นของผู้ใช้งานเมื่อสินค้าถูกส่งมอบให้กับผู้ให้บริการขนส่ง เว้นแต่ในกรณีที่เกิดจากความผิดพลาดของบริษัท หรือมีข้อกำหนดเป็นอย่างอื่น
e. หากเกิดเหตุสุดวิสัย เช่น ภัยธรรมชาติ การจลาจล หรือเหตุอื่นใดที่อยู่นอกเหนือการควบคุมของบริษัท บริษัทขอสงวนสิทธิ์ในการเลื่อนระยะเวลาการจัดส่งโดยไม่ต้องรับผิดชอบต่อความเสียหายที่อาจเกิดขึ้น
7. การยกเลิกคำสั่งซื้อ
a. ผู้ใช้งานสามารถแจ้งความประสงค์ในการยกเลิกคำสั่งซื้อได้ ก่อนที่คำสั่งซื้อจะเข้าสู่กระบวนการจัดส่ง โดยต้องติดต่อผ่านบริษัทผ่านช่องทางที่กำหนด ได้แก่

b. การยกเลิกคำสั่งซื้อจะมีผลเมื่อได้รับการยืนยันจากบริษัทเท่านั้น หากคำสั่งซื้อนั้นอยู่ระหว่างการจัดส่งหรือเตรียมสินค้า บริษัทขอสงวนสิทธิ์ในการปฏิเสธคำขอยกเลิก
c. บริษัทขอสงวนสิทธิ์ในการยกเลิกคำสั่งซื้อของผู้ใช้งาน ไม่ว่าทั้งหมดหรือแต่บางส่วน โดยไม่ต้องแจ้งเหตุล่วงหน้าในกรณีดังต่อไปนี้
i. สินค้าไม่มีสต๊อกหรือเลิกจำหน่าย
ii. ข้อมูลสินค้า เช่น ราคา หรือรายละเอียด มีข้อผิดพลาด
iii. ระบบการชำระเงินไม่สำเร็จหรือไม่ได้รับการยืนยัน
iv. ไม่สามารถติดต่อผู้ใช้งานเพื่อยืนยันข้อมูลหรือดำเนินการจัดส่ง
v. มีเหตุอันควรสงสัยว่าเป็นคำสั่งซื้อที่ผิดปกติหรืออาจเกี่ยวข้องกับการฉ้อโกง
d. ในกรณีที่บริษัทเป็นฝ่ายยกเลิกคำสั่งซื้อ บริษัทจะดำเนินการคืนเงินให้ผู้ใช้งานเต็มจำนวนโดยเร็วผ่านช่องทางเดียวกับที่ใช้ในการชำระเงิน เว้นแต่ตกลงไว้เป็นอย่างอื่น
8. การคืนสินค้าและคืนเงิน
a. ผู้ใช้งานมีสิทธิบอกเลิกการสั่งซื้อสินค้าและคืนสินค้าได้ภายใน 21 วัน นับแต่วันที่ได้รับสินค้า โดยไม่จำเป็นต้องระบุเหตุผล ทั้งนี้ต้องแจ้งความประสงค์เป็นลายลักษณ์อักษรผ่านช่องทางที่บริษัทกำหนด พร้อมแนบหลักฐานคำสั่งซื้อ
b. สินค้าที่จะขอคืนต้องอยู่ในสภาพสมบูรณ์ ไม่ผ่านการใช้งานหรือเปลี่ยนแปลง และต้องคืนพร้อมบรรจุภัณฑ์เดิม ใบเสร็จรับเงิน และเอกสารอื่นที่เกี่ยวข้อง หากสินค้าไม่เข้าเงื่อนไขข้างต้น บริษัทขอสงวนสิทธิ์ไม่รับคืนสินค้า
c. บริษัทขอสงวนสิทธิ์ไม่รับคืนสินค้าในกรณีต่อไปนี้:
i. สินค้าชำรุดหรือเสียหายจากการใช้งานโดยผู้ใช้งาน
ii. สินค้าสั่งผลิตเฉพาะบุคคล (custom-made)
iii. สินค้าโปรโมชั่น สินค้าลกราคาพิเศษ หรือ Clearance ที่ระบุว่าไม่สามารถคืนได้
d. ผู้ใช้งานจะต้องรับผิดชอบค่าจัดส่งคืน เว้นแต่กรณีที่เป็นความผิดของบริษัท เช่น จัดส่งผิดรุ่น ผิดสี หรือสินค้าเสียหายจากต้นทาง ซึ่งบริษัทจะรับผิดชอบค่าจัดส่งและดำเนินการเปลี่ยนหรือคืนเงินให้ตามความเหมาะสม
e. บริษัทจะดำเนินการคืนเงินภายใน 15 วันทำการนับจากวันที่ตรวจสอบและอนุมัติการคืนสินค้าเรียบร้อยแล้ว โดยจะคืนผ่านช่องทางเดียวกับที่ใช้ในการชำระเงิน เว้นแต่จะตกลงเป็นอย่างอื่น
f. ผู้ใช้งานสามารถแจ้งความประสงค์ในการคืนสินค้าได้ที่

9. ทรัพย์สินทางปัญญา
a. ข้อความ รูปภาพ วิดีโอ โลโก้ กราฟิก ไฟล์เสียง โค้ดโปรแกรม รวมถึงเนื้อหาอื่นใดที่แสดงบนเว็บไซต์นี้ (“เนื้อหา”) ถือเป็นทรัพย์สินทางปัญญาของบริษัท หรือของผู้ให้อนุญาตแก่บริษัท โดยได้รับความคุ้มครองตามกฎหมายว่าด้วยลิขสิทธิ์ เครื่องหมายการค้า สิทธิบัตร หรือกฎหมายอื่นที่เกี่ยวข้อง
b. ห้ามมิให้ผู้ใช้งานคัดลอก ดัดแปลง ทำซ้ำ เผยแพร่ จำหน่าย แสดงต่อสาธารณะ หรือใช้เนื้อหาบนเว็บไซต์นี้ไม่ว่าทั้งหมดหรือแต่บางส่วน เพื่อวัตถุประสงค์ทางการค้า หรือวัตถุประสงค์อื่นใดโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรจากบริษัท
c. การเข้าถึงเว็บไซต์ไม่ถือว่าเป็นการให้สิทธิหรืออนุญาตใดๆแก่ผู้ใช้งานในทรัพย์สินทางปัญญาของบริษัท และบริษัทขอสงวนสิทธิในการดำเนินการทางกฎหมายหากพบการละเมิด
10. ความรับผิดชอบ
a. บริษัทมุ่งมั่นให้ข้อมูลและบริการบนเว็บไซต์มีความถูกต้องและทันสมัย แต่ไม่รับประกันว่าเนื้อหาหรือฟังก์ชันการทำงานของเว็บไซต์จะปราศจากข้อผิดพลาด หรือหยุดชะงักตลอดเวลา
b. บริษัทไม่รับผิดชอบต่อความเสียหายใดๆที่เกิดขึ้นแก่ผู้ใช้งานจากการใช้งานเว็บไซต์ รวมถึงแต่ไม่จำกัดเฉพาะ ความสูญเสียของข้อมูล รายได้ หรือผลกำไร ความเสียหายต่อระบบคอมพิวเตอร์ หรือผลกระทบจากไวรัสคอมพิวเตอร์
c. บริษัทขอสงวนสิทธิ์ในการระงับ ปรับปรุง หรือเปลี่ยนแปลงการให้บริการเว็บไซต์ชั่วคราวหรือถาวร โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า และจะไม่รับผิดชอบต่อผลกระทบใดๆที่เกิดขึ้นจากการเปลี่ยนแปลงดังกล่าว
d. ความรับผิดชอบของบริษัทภายใต้ข้อกำหนดและเงื่อนไขนี้จะไม่เกินมูลค่าของสินค้าที่ผู้ใช้งานได้ชำระจริงในคำสั่งซื้อที่เป็นปัญหา เว้นแต่กฎหมายกำหนดไว้เป็นอย่างอื่น
11. การเปลี่ยนแปลงข้อกำหนด
a. บริษัทขอสงวนสิทธิ์ในการเปลี่ยนแปลง แก้ไข หรือเพิ่มเติมข้อกำหนดและเงื่อนไขการใช้งานเว็บไซต์นี้ได้ตลอดเวลา โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า
b. การเปลี่ยนแปลงใดๆจะมีผลเมื่อมีการเผยแพร่ข้อกำหนดและเงื่อนไขฉบับปรับปรุงบนเว็บไซต์ ผู้ใช้งานมีหน้าที่ตรวจสอบข้อกำหนดและเงื่อนไขล่าสุดด้วยตนเองอย่างสม่ำเสมอ
c. การเข้าใช้งานเว็บไซต์หลังจากมีการเปลี่ยนแปลงข้อกำหนด ถือว่าผู้ใช้งานได้ยอมรับข้อกำหนดและเงื่อนไขฉบับใหม่โดยอัตโนมัติ
12. กฎหมายที่ใช้บังคับ
ข้อกำหนดและเงื่อนไขการใช้งานเว็บไซต์นี้อยู่ภายใต้บังคับแห่งกฎหมายของราชอาณาจักรไทย และการตีความหรือข้อพิพาทใดๆที่เกิดขึ้นจากการใช้งานเว็บไซต์ หรือการซื้อขายสินค้าระหว่างผู้ใช้งานกับบริษัท ให้อยู่ภาจใต้เขตอำนาจของศาลไทย

15. การรับประกันสินค้า
สินค้าบางประเภทอาจมีการรับประกันตามเงื่อนไขพาะของผู้ผลิตหรือบริษัท ซึ่งจะแสดงไว้ในหน้ารายละเอียดสินค้า หรือนโยบายการรับประกันสินค้าที่ระบุแยกต่างหาก ลูกค้าสามารถศึกษารายละเอียดได้ที่ เงื่อนไขการรับประกันสินค้า
